Acceptable Use Policy

This policy describes what is and is not permitted when using the Blue Replies platform. All customers must comply with these guidelines.
1. General Conduct Requirements
Lawful Use
You may only use the Service for lawful purposes and in accordance with these guidelines. You must comply with all applicable local, state, national, and international laws and regulations, including but not limited to laws governing privacy, consumer protection, and telecommunications.
Good Faith
You must use the Service in good faith and in a manner consistent with its intended purpose: enabling legitimate business communications via iMessage. Attempting to exploit, circumvent, or abuse the Service in any way is prohibited.
Account Responsibility
You are responsible for all activity conducted through your account. You must maintain the confidentiality of your API keys and credentials. You must not share access to the Service with unauthorized parties.
2. Prohibited Content
Illegal Content
You must not transmit, distribute, or store content that violates any applicable law or regulation, including content related to illegal drugs, weapons, counterfeit goods, human trafficking, or child exploitation.
Harmful or Deceptive Content
You must not use the Service to transmit content that is threatening, harassing, abusive, defamatory, obscene, or fraudulent. This includes phishing attempts, false advertising, impersonation of persons or entities, and deceptive marketing practices.
Rights-Infringing Content
You must not transmit content that infringes upon the intellectual property rights, privacy rights, or other legal rights of any third party.
3. Prohibited Messaging Practices
Spam
You must not send unsolicited bulk messages, chain messages, or any messages to recipients who have not provided prior express consent to receive communications from you. All messaging must be opt-in.
TCPA Compliance
You are solely responsible for complying with the Telephone Consumer Protection Act (TCPA). This includes obtaining prior express written consent before sending marketing messages, honoring opt-out requests promptly (within 10 business days), and maintaining proper consent records.
CAN-SPAM Compliance
All commercial messages must comply with the CAN-SPAM Act, including accurate header information, a valid physical postal address, and a clear and conspicuous opt-out mechanism.
International Compliance
If you send messages to recipients outside the United States, you must also comply with the applicable laws of those jurisdictions, including CASL (Canada), GDPR (EEA/UK), and similar regulations.
No Prohibited Industries
The Service may not be used by or for: payday lending, debt collection, gambling, adult content, firearms (without prior approval), cannabis (where illegal), multi-level marketing, or any industry we determine in our sole discretion to be high-risk.
4. Prohibited Technical Activities
System Interference
You must not interfere with, disrupt, or attempt to gain unauthorized access to any servers, networks, or systems connected to the Service. This includes distributed denial-of-service (DDoS) attacks, port scanning, and vulnerability probing.
Unauthorized Access
You must not attempt to access any portion of the Service, or any systems or networks connected to the Service, that you are not authorized to access. You must not use any means to bypass authentication or security measures.
Reverse Engineering
You must not reverse engineer, decompile, disassemble, or attempt to derive the source code, algorithms, or trade secrets of the Blue Replies platform, API, or any related technology.
API Abuse
You must not use the API in a way that imposes an unreasonable burden on our infrastructure, including but not limited to: automated stress testing, intentional flooding of queues, or making requests in bad faith solely to consume resources.
Malware
You must not transmit any viruses, worms, Trojan horses, ransomware, spyware, or any other malicious or destructive code through the Service.
5. Rate Limiting and Abuse Prevention
Your API usage is subject to rate limits specified in your plan. Rate limits are enforced to ensure fair usage and platform stability. Exceeding your rate limits may result in temporary throttling or request rejection.
We monitor usage patterns for signs of abuse. Unusual activity — such as high bounce rates, an abnormal volume of failed deliveries, or patterns consistent with spam campaigns — may result in rate limit reductions, account review, or suspension.
We reserve the right to impose additional rate limits or usage restrictions on any account that we determine, in our sole discretion, is using the Service in a manner that threatens platform integrity or violates this policy.
6. Messaging Best Practices
Identify Yourself
Always clearly identify your business in your messages. Recipients should know immediately who is contacting them.
Honor Opt-Outs
Honor all opt-out requests immediately. Maintain a suppression list and do not re-add opted-out contacts without new express consent.
Send Relevant Messages
Send only content that is relevant and expected based on the consent obtained from recipients. Do not deviate from the purpose for which consent was obtained.
Message Frequency
Be mindful of message frequency. Sending too many messages in a short period can damage your sender reputation and result in Apple flagging your lines.
Keep Records
Maintain records of consent, including when and how consent was obtained, for all contacts you message through the Service. These records may be requested in the event of a compliance audit or dispute.
7. Reporting Violations
If you become aware of any violation of this Acceptable Use Policy, or if you receive unsolicited messages sent through our platform, please report it immediately to [email protected].
We take all abuse reports seriously and will investigate promptly. Providing detailed information, including message content, sender information, and timestamps, will help us act quickly.
8. Consequences of Violations
Violations of this Acceptable Use Policy may result in one or more of the following actions, at our sole discretion:
Warnings
For minor or first-time violations, we may issue a warning and require corrective action within a specified timeframe.
Rate Limiting or Throttling
We may reduce your API rate limits or impose throttling to mitigate the impact of policy-violating activity.
Suspension
We may temporarily suspend your account pending investigation or until violations are remediated.
Termination
Serious or repeated violations may result in immediate, permanent termination of your account without refund.
Legal Action
We reserve the right to report violations to law enforcement, cooperate with regulatory investigations, and pursue civil remedies for damages caused by policy violations.
9. Changes to This Policy
We reserve the right to modify this Acceptable Use Policy at any time. We will provide notice of material changes via email or in-app notification at least 14 days before the changes take effect. Your continued use of the Service after the effective date of any changes constitutes acceptance of the revised policy.
